Terms of Service

Welcome to Pakyas. By using our service, you agree to these Terms of Service. Please read them carefully.

1. Definitions

• "Service" means the Pakyas platform, website, APIs, CLI, and related services.
• "User" means an individual or entity using Pakyas.
• "Content" means data, logs, payloads, metadata, and configuration submitted by users.
• "Execution Signal" means a signal emitted by a job indicating start, completion, or progress of execution, used to determine job state.

2. Service Description

Pakyas is a job monitoring service designed to verify whether jobs actually ran, ran on time, and completed within expected bounds—based on execution signals emitted by the job itself. We provide:

• Execution-signal–based monitoring for scheduled jobs
• Alert notifications when jobs are missing, late, or overrunning
• Job execution tracking including duration and exit codes
• Error log capture and storage
• Public and private status pages
• CLI tools and API access

Pakyas does not treat the absence of execution signals as confirmation that a job ran successfully.

3. Account Terms

To use Pakyas, you must:

• Be legally capable of entering into these Terms, or have permission from a parent or legal guardian
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized account access
• Be responsible for all activity under your account

You may not share your account credentials or API keys with unauthorized parties. Each user should have their own account.

4. Acceptable Use

You agree not to use Pakyas to:

• Violate any applicable laws or regulations
• Send spam, malware, or malicious content
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt our services
• Abuse our API beyond reasonable or documented usage limits
• Use the service to monitor illegal activities

We may enforce rate limits, quotas, or other technical restrictions to ensure fair usage and service stability. We reserve the right to suspend or terminate accounts that violate these terms.

5. Payment and Billing

Pakyas offers free and paid subscription plans. For paid plans:

• Payments are processed securely through Lemon Squeezy
• Subscriptions are billed monthly or annually, depending on your selection
• You may cancel at any time; access continues until the end of the billing period
• Refunds are handled on a case-by-case basis
• Prices may change with 30 days' notice for existing subscribers

If payment fails, we may suspend your account until the issue is resolved. Downgrading may result in loss of features or data retention beyond your new plan's limits.

6. Your Data

You retain ownership of all data you submit to Pakyas. By using our service, you grant us permission to:

• Store and process your job metadata, logs, and payloads
• Send notifications on your behalf
• Display your data on status pages you configure

You are solely responsible for the content of the data you submit. You agree not to submit sensitive personal data, credentials, secrets, or regulated information unless explicitly supported by the service.

We will not sell your data to third parties. See our Privacy Policy for details on how we handle your information.

7. Service Availability

We strive to maintain high availability for Pakyas. However:

• We do not guarantee 100% uptime
• Scheduled maintenance will be announced in advance when possible
• We may modify or discontinue features with reasonable notice
• Service interruptions may occur due to factors beyond our control

Current service status is available at pakyas.com/status. Public status pages are informational only and do not replace execution-signal–based job monitoring or internal operational checks.

8. Limitation of Liability

To the maximum extent permitted by law:

• Pakyas is provided "as is" without warranties of any kind
• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid us in the past 12 months
• We are not responsible for failures in your monitored jobs or systems
• Pakyas evaluates execution signals but does not verify the correctness, completeness, or business impact of the job's work

Pakyas is a job monitoring and alerting service based on execution signals emitted by user-controlled jobs. We help you detect when jobs are missing, late, or overrunning, but we do not prevent or resolve failures in your own infrastructure. Pakyas relies on third-party providers for infrastructure and notifications. We are not responsible for outages or failures caused by third-party services.

9. Termination

You may close your account at any time from your account settings. We may suspend or terminate your account if:

• You violate these terms
• Your payment method fails repeatedly
• We are required to do so by law
• We discontinue the service entirely

Upon termination, you may request an export of your data within 30 days. After that, your data will be permanently deleted unless legally required to retain it.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes arising out of or relating to these Terms or the use of the Service shall be subject to the exclusive jurisdiction of the courts of the Philippines.

11. Changes to These Terms

We may update these terms from time to time. We will notify you of significant changes via email or through the service. Continued use of Pakyas after changes take effect constitutes acceptance of the updated terms.
